The Nigerian legal system recognizes three different types of marriages; statutory marriage, customary marriage and Islamic marriage. These different marriages also have a system for divorce. Under customary marriages, return of bride price constitute divorce. Where bride price is not returned, an action can be filed at a customary court for the dissolution of the marriage. A statutory marriage is a marriage conducted at a government approved marriage registry or a licensed place of worship. A statutory marriage can only be dissolved by an Order of Court, hence a person must file an action in Court to seek dissolution of marriage.
